Definitions

• “Facility” means the premises operated by The Hustle Hub, including all courts, equipment, amenities, changing rooms, parking, foyer and associated areas.
• “Booking” means a reservation made by a Customer to use the Facility (for example court hire, event, program or training session).
• “Customer” or “you” means the person (or organisation) who makes the Booking and/or uses the Facility.
• “We”, “us”, “our” means The Hustle Hub.
• “Program” means any coaching, training, league, competition, clinic or session run by The Hustle Hub at the Facility.
• “Rules” means these Terms & Conditions, the Facility rules, policies (including safety, conduct, cancellation), and any signage or instructions displayed at the Facility or on the Website.

1. Booking and payment

• A Booking is confirmed only when payment (or deposit, if applicable) has been received by us.
• You agree to pay all fees quoted on the Website or as otherwise notified prior to your use of the Facility.
• We reserve the right to vary prices, fees or charges at any time, and such variation will apply to future Bookings only, unless otherwise stated.
• For group bookings or long-term bookings we may require a deposit or bond (refundable subject to conditions).
• You must ensure the accuracy of all booking information you provide (date, time, number of participants, age groups, etc.).
• If you reduce numbers, change times or cancel you may incur cancellation or variation fees (as per our policy).
• We reserve the right to refuse any Booking.

2. Cancellation, variation & refunds

• You may cancel or vary your Booking in accordance with our cancellation policy (which we will provide and/or which is displayed on our Website).
• In some cases, cancellation may result in retention of part or all of the fee (or deposit) if notice is not given within the required period.
• We may cancel or reschedule a Booking (for example due to maintenance, unforeseen events, facility damage, weather, safety reasons) and in such cases we will notify you as soon as practicable and refund or offer alternative times.
• We are not liable for any other costs, losses or damages you may incur as a result of a cancellation or variation by us (except to the extent prohibited by law).

3. Use of the Facility & conduct

• You must comply with our Rules, any instructions given by staff, and signage at the Facility at all times.
• The Facility must be used only for the agreed purpose (e.g., basketball court hire) and during the booked period.
• You must not allow or engage in behaviour which is unsafe, disruptive, illegal, offensive or likely to damage property or the reputation of the Facility.
• Appropriate footwear, clothing and protection must be worn. Long-cleated shoes, metal studs or other footwear that may damage the court surface may be prohibited.
• You must leave the booked area in a clean and tidy condition. Any damage caused by you (or your invitees) will be your responsibility.
• You acknowledge the Facility is not exclusive (unless otherwise agreed) and that we may permit other Bookings/events before, during or after your Booking.

4. Health, safety & risk

• Use of the Facility involves risk of injury. You accept that you use the Facility at your own risk and acknowledge it is your responsibility to take care of your own safety and the safety of others you bring.
• You must inspect the Facility prior to use and notify us of any hazard, defect, damage or unsafe condition.
• You warrant that you (and your participants) are physically fit, able and properly prepared for the activity, and will immediately stop participating if you become unwell or unsafe to continue.
• Children and minors must be supervised in accordance with our supervision policies (for example, under 18s must be accompanied by a responsible adult unless otherwise agreed).
• You agree to comply with all health, hygiene, safety and other rules (including emergency procedures) in place at the Facility.
• We may refuse access or ask you to leave if you do not comply with our health and safety requirements or staff instructions.

5. Liability, indemnity & insurance

• To the extent permitted by law, we exclude liability for any loss, damage, cost or expense incurred by you (or a participant) in connection with the use of the Facility, whether arising from our negligence or otherwise.
• You indemnify us (and our officers, employees and agents) against any claim, liability, loss or damage which arises out of your use of the Facility, breach of these Terms or misconduct of you or your participants.
• You are responsible for your personal property and for the property of participants and invitees — we are not liable for theft, loss or damage of personal items.
• We recommend you take out appropriate insurance (public liability, personal injury) relevant to your Booking/activities.
• Nothing in these Terms is intended to limit or exclude any liability which cannot legally be limited or excluded (for example certain statutory consumer guarantees under the Australian Consumer Law).

6. Equipment, facilities & hire

• If equipment (balls, hoops, timers, etc) is provided, you agree to use it only for its intended purpose and to return in the same condition. You must not damage or alter Equipment.
• We may charge repair/replacement costs if equipment is damaged beyond fair wear.
• If your Booking includes exclusive hire of changing rooms, locker rooms or other amenities, you must ensure those areas are left clean, and you are responsible for any damage or extra cleaning required.

7. Photography, filming & promotion

• You consent to us using photographs or images of the Facility or you (and your group) in promotional, marketing or social media materials unless you notify us in writing that you do not consent.
• You must not film, photograph or live-stream at the Facility without our prior written approval. Filming that involves minors is subject to additional consent.
• If approved, you are responsible for any licences, approvals, clearances, or payments required for filming, audio, music, privacy or copyright.

8. Alcohol, smoking & controlled substances

• Consumption of alcohol or illegal drugs on the Facility grounds is prohibited unless authorised by us under special arrangements (and in compliance with applicable law/licence).
• Smoking or vaping is prohibited inside enclosed areas and in any areas as per law or signage.
• You must not bring glass bottles, fireworks, flammable or dangerous materials onto the Facility unless authorised in writing.

9. Damage, cleaning & restoration

• You must report any damage, loss or malfunction of Facility, fixtures or equipment to us immediately.
• We may retain part or all of any bond or charge additional fees to cover damage, cleaning or repair costs resulting from your Booking or participants.
• You must vacate the Facility promptly at the end of your booked time. If you do not, we may charge additional overtime fees.

10. Cancellation or termination by us

• We reserve the right to cancel or terminate a Booking or your access to the Facility if you breach these Terms or any rules, act in a way we deem unsafe or disruptive, or if the Facility becomes unavailable (due to maintenance, weather, emergency, or other reason beyond our control).
• On termination by us for your breach, you may not be entitled to any refund and you may still be liable for any fees or costs incurred.
• We may suspend or prohibit access for future Bookings if you fail to comply with these Terms.

11. Intellectual property & website use

• All content on our Website (including logos, text, graphics, images) is owned or licensed by us, and you must not reproduce or use it without our permission.
• When you make a Booking or access our Website you must provide accurate information and not impersonate others or use false or misleading information.
• If you provide feedback, suggestions or ideas relating to the Facility or our services, you grant us a non-exclusive, royalty-free licence to use them for any purpose.

12. Privacy & personal data

• We collect, store and use personal information about a Customer and participants as necessary to perform our services (Bookings, contact, operations, safety).
• Our Privacy Policy (available on our Website) sets out how we collect, use, disclose and manage personal information.
• By using the Facility and making a Booking you consent to the collection, storage and use of personal information as set out in our Privacy Policy.
• You must ensure you obtain any necessary consents for minors or other participants you bring to the Facility.

13. Special events, leagues & programs

• For special events, competitions, leagues, clinics or training programs we may impose additional terms (such as code of conduct, dress standard, eligibility, substitution rules). You must comply with those additional terms.
• We may at our discretion accept or reject applications to participate in Programs or Events.
• Program fees, withdrawal, substitution and refund policies will be as provided to you (or displayed on our Website) and may differ from casual court hire terms.

14. Force majeure & unforeseen circumstances

• We will not be liable for any failure or delay in performing our obligations under a Booking or these Terms if caused by circumstances beyond our reasonable control (including but not limited to acts of God, fire, flood, storm, power failure, pandemic, civil unrest, vandalism).
• In such cases, we may cancel or postpone services, bookings or the Facility access without liability beyond refunding any prepaid amounts for the affected booking (if applicable and at our discretion).

15. Severability & waiver

• If any term or provision of these Terms is held invalid or unenforceable (in whole or part) it will be read down or severed to the extent necessary and the remaining Terms will continue in full force.
• No waiver by us of any breach of these Terms is a waiver of any subsequent breach.

16. Entire agreement

• These Terms, together with any Booking confirmation, Booking policy, schedule of fees, and any additional terms communicated to you constitute the entire agreement between you and us regarding your use of the Facility.
• They supersede all prior negotiations, representations or communications (except fraudulent misrepresentations).

17. Governing law & jurisdiction

• These Terms are governed by the laws of the State of Victoria, Australia.
• You submit to the non-exclusive jurisdiction of the courts of Victoria and/or of the Commonwealth of Australia to resolve any dispute.
